China Taiping Insurance (Singapore) Pte. Ltd. ("China Taiping")’ websites and mobile applications currently provide users access to a collection of online resources, including various communication tools, commercial services, and personalised content and information (collectively “Online Facilities”).

The websites and mobile applications are intended for use by individuals who are not physically situated in the European Union or in the United Kingdom. If you are physically situated in the European Union or the United Kingdom, please refrain from using the websites and exit immediately. China Taiping Singapore reserves the right to amend and update any of the terms and conditions herein without notice, and at its sole and absolute discretion. You are legally bound by these Terms of Use and any subsequent revisions. As such, you should, at regular intervals, visit this page to view the latest version of the Terms of Use which supersedes any earlier versions. Your access to and use of the websites in any of our Online Facilities including the EzClaim websites (collectively, “Websites”) constitutes your acceptance of these Terms of Use. Please read these Terms of Use carefully before using the Online Facilities. If you do not agree to these Terms of Use, you must not access or use any of the Online Facilities.

Evidence of Transactions

You agree that China Taiping Singapore’s records of your transactions shall be accepted as conclusive and binding for all purposes subject to any applicable or relevant terms in any relevant written agreement(s) that you have entered into with China Taiping. Your use of your account and/or password to access or use this Online Facilities including access to your clients and your policy records and our on-line services will be recognized as your electronic signature and will be legally binding. To the extent permitted by law, you accept that China Taiping's electronic records will be admissible as original documents in any court of law and agree that you will not challenge or dispute the accuracy or authenticity of such records.

Performance of Online Facilities (i.e Website)

China Taiping will use reasonable efforts to keep the information in the Online Facilities up-to-date and correct. However, the availability of the Online Facilities also depends on various third party service providers, and accordingly, China Taiping does not guarantee that your use of the Online Facilities will be 100% continuous, uninterrupted, secure or error-free.

The performance of the Online Facilities depends on various factors, including the functions, capacity and configuration of your computer, mobile phone and/or tablet (“Device”), the speed of your internet connection, and the number of users accessing the systems which support the Online Facilities. China Taiping makes no guarantee as to the reliability or other performance of the Online Facilities.

China Taiping makes no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability or availability with respect to the Online Facilities or the information, products, services, or related graphics contained in the Online Facilities for any purpose. Any reliance you place on such information is therefore strictly at your own risk.

Third Party Links

Through this Online Facilities you are able to link to other websites which are not under the control of China Taiping. We have no control over the nature, content and availability of those sites. It is your responsibility to check and read their terms and conditions where applicable. The inclusion of any links does not necessarily imply a recommendation or endorse the views expressed within them.

Intellectual Property

All copyright and other intellectual property rights in the Online Facilities are proprietary to us and our licensors.

Any and all service or trademarks, logos, images and/or contents (“Intellectual Property”) on this Online Facilities in any of the Websites may not be copied, reproduced, published, displayed, adapted, distributed, stored, hyperlinked or otherwise used in whole or in part in any manner and in any form without the express prior written consent of China Taiping Singapore or the owner of such Intellectual Property. Any pictures or images or audio materials or video materials displayed on this Online Facilities belong to China Taiping or are displayed by China Taiping with the permission of the owners of these pictures or images or audio materials or video materials. The use of these pictures or images or audio materials or video materials without the prior written consent of China Taiping Singapore or the relevant owner is prohibited.

User Conduct

· You may not copy, modify, transmit, distribute, reproduce, publish, or sell any information, materials, products or services obtained from our websites or Online Facilities, or use them in any commercial manner without the prior written consent of China Taiping.

· You will not use our websites or Online Facilities in any manner that could damage, or disable any of our websites and Online Facilities or its network.

· You will not use or act on or through any of our Website or the Online Facilities, directly or indirectly, to commit any crimes and must not access, or permit any other party to access, our Website and/or any of the Online Facilities for any activity of an illegal, fraudulent or defamatory nature.

· You will not attempt to gain unauthorized access to any of our websites, our Online Facilities, accounts, computer systems or networks connected to our websites, our Online Facilities, through hacking, password mining or any other means.

· You will not attempt to obtain any materials or information through any means not intentionally made available through our websites, or Online Facilities.

Limitation of Liability

No liability or responsibility shall be borne by China Taiping for any damages (whether direct or indirect, punitive, special, exemplary, incidental, or consequential (including loss of business revenue, profits, use, data) however it arises, whether for breach of contract or in tort) suffered as a result of your use, modification, submission, copying, distribution, or downloading of any materials from our  Website in the Online Facilities and/or any third party links, any computer viruses downloaded into any Device or internet access device as a consequence of your use of our Website or any of the Online Facilities or your downloading of any materials, images or data from any of our Website (including any website or third party links in any of the Online Facilities.)

Indemnity

You hereby agree to fully indemnify, defend and hold harmless China Taiping from and against any and all damages, losses, liabilities, costs and expenses (including reasonable attorneys' fees and disbursements) suffered by China Taiping arising from or in connection with: (i) your access to or use of this website and/or online facilities; (ii) any other party’s access to or use of this website and/or online facilities using your account and/or password; or (iii) your breach of any of these Conditions; (iv) any other party’s breach of any of these Conditions where such party was able to access or use this website and/or online facilities using your account and/or password.

Disclaimer of Warranty

All information, contents and materials which we furnished on our Website and any of the Online Facilities are provided on as “as is”” basis. Whilst we take reasonable efforts to ensure that all information, contents and materials on our Websites and any of the Online Facilities are complete, correct, accurate and up to date at the time they are published, we cannot guarantee that all such information, contents and materials are correct, accurate and up to date at all times. China Taiping  disclaims any representations and warranties (whether express or implied), or guarantees as to the quality, suitability, truth, accuracy or completeness of any of the information, contents and/or materials contained in our Websites and any of the Online Facilities or the continued and undisrupted access or availability of our Websites and any of the Online Facilities. Any reliance you place on such information, content or materials is therefore strictly at your own risk.

Additional Terms and Conditions applicable to Mobile Application Users only

A) Notifications and Alerts

You agree to receive pre-programmed notifications on the mobile application on your mobile telephone, ipad or other handheld devices.

B) Usage of Mobile Application

· You will not attempt to circumvent our security or network including to access data not intended for you, or log into a server or account you are not expressly authorized to access;

· You will not execute any form of network monitoring which will intercept data not intended for you;

· You will not extract data from or hack into the mobile application.

C) User Data usage Information

Some functionality of the Application, such as location based services and functionality, may require the transmission of information provided by the User including but not limited to user names, the International Mobile Equipment identity number accessed in the User’s Device, , information related to GPS location (“User Information”). If the User uses such Application functionality, the User consents to the transmission of User Information to China Taiping to process and store such User Information as necessary for the Application functionality and for purposes described in China Taiping’s Privacy Policy.

D) Analytics Data collections

China Taiping collects information regarding your activities (“Data”) while using mobile applications. We will process and analyse the Data using our backend Systems and generate an analytics visual report (the “Reports”), including graphs and statistics of the data collected.

E) Apple Terms and Conditions

For the avoidance of doubt, the Apple Terms and Conditions, including, without limitation, the Licensed Application End User License Agreement (“Apple Terms”) supplements China Taiping’s Terms of Use where any of the  mobile application is distributed through Apple, Inc. Please refer to www.apple.com/legal/itunes/us/terms.html#service. If any of the provisions of the Apple Terms conflict with our Terms of Use, the relevant Apple Terms will control, solely to the extent such terms apply to any of our mobile application.

Severability

The invalidity, unlawfulness or unenforceability of any provision in these Terms of Use in any respect under applicable law shall not affect the validity, legality or enforceability of the remaining provisions hereof.

Governing law and jurisdiction

These Terms of Use will be governed by the laws of the Singapore and the parties agree to submit to the exclusive jurisdiction of the courts of Singapore.

China Taiping may terminate or suspend your access to our Online Facilities immediately, without prior notice or liability for any reason whatsoever, if you breach any of these Terms of Use.
